Sexual Assault Forensic Evidence (SAFE) Kits

This directive requires the testing of all SAFE Kits released to law enforcement, including the creation of a plan to test all previously-untested kits that were released to law enforcement. This Directive also requires the forensic laboratory notify the Director of the Division of Criminal Justice and the New Jersey State Police Regional Operations & Intelligence Center (NJ ROIC) as soon as practicable when SAFE Kit test results that have been uploaded to the Combined DNA Index System (CODIS) result in a match, which will facilitate New Jersey’s investigation and identification of serial offenders.

Attorney General Platkin SAFE Kit Directive: April 2024

This directive expanded the SART activation and response time from five (5)-days to seven (7)-days post-assault. The SART is comprised of a Confidential Sexual Violence Advocate (CSVA), a Forensic Nurse Examiner (FNE), and a law enforcement officer.

This directive extended the required SAFE Kit retention period from five years to 20 years. It also established statewide procedures and guidelines for tracking, storing, and determining how and when such evidence is submitted for testing, and limited circumstances in which law enforcement can decline to submit evidence for testing in cases where a survivor has consented to it.

This third edition of the Standards was issued in the form of an AG Directive to update guidelines for the provision of SART services throughout the State.

This directive expanded the SAFE Kit retention timeline from 90-day to 5-years.
