Housing Discrimination Protections

The New Jersey Law Against Discrimination (LAD) prohibits discrimination in housing based on actual or perceived protected characteristics. The Fair Chance in Housing Act prohibits landlords from rejecting prospective tenants because of their criminal history except in certain limited circumstances.

AG Platkin, Division on Civil Rights Takes Enforcement Action to Combat Disability Discrimination

March 28, 2023 – DCR has issued Findings of Probable Cause in ten cases involving allegations that an employer, a housing provider, or a place of public accommodation has violated the Law Against Discrimination (LAD) by discriminating on the basis of disability. Read the press release here.

AG Platkin, Division on Civil Rights Take Enforcement Action to Hold Municipalities Accountable for LGBTQIA+ Discrimination in Marriage Licensing

March 8, 2023 – DCR has issued Notices of Violation to 28 municipalities across the state for allegedly violating the Law Against Discrimination by publishing marriage license application forms on their websites that exclude certain LGBTQIA+ individuals seeking to obtain marriage licenses. NJ Office of the Secretary of Higher Education and the Division on Civil Rights Release a Resource Guide for Postsecondary Institutions on Campus Responses to Bias

February 24, 2023 – The Office of the Secretary of Higher Education (OSHE) and New Jersey’s Division on Civil Rights (DCR) released the “Addressing Bias on Campus” resource guide. The “Addressing Bias on Campus” resource guide will provide New Jersey campus stakeholders with the tools to prevent and respond to bias incidents effectively. Read the press release here.

Division on Civil Rights Takes Enforcement Action against Housing Providers for Non-Compliance with the Fair Chance in Housing Act

February 24, 2023 – DCR has issued 59 Notices of Violation to housing providers around the State for allegedly violating New Jersey’s Fair Chance in Housing Act (FCHA) by asking criminal history-related questions on housing applications that are prohibited by the law, or by posting housing advertisements or maintaining housing policies that do not comply with FCHA. Required Posters

On August 1, 2022, DCR adopted new and amended regulations to increase the visibility and effectiveness of posters that the State requires employers, housing providers, and places of public accommodation to display to inform people of their rights under New Jersey’s Law Against Discrimination (LAD) and Family Leave Act (FLA). All covered businesses, employers, and housing providers are required by law to display the applicable posters.

If you have prior versions of these posters displayed, please remove them and replace them with the updated posters, which can be found here. Click here to read the regulations and here to read the press release.

DCR Reaches Landmark Settlement in Mortgage Redlining Case
